These Terms of Use ("Terms") are an agreement between you and the Your Future company that operates the site or service you use. Please read them carefully. By using a Site, you agree to these Terms. If you do not agree, please do not use the Sites.
1. Who we are and what these Terms cover
1.1 Operators
| Site or service | Operator |
|---|---|
| yourfuturecareer.vip and jobboard.yourfuturecareer.vip, including the Jobs, Submit Resume, Intake Form, subscription, and "Your Future Employee" talent network pages | Your Future Career LLC ("YFC") |
| YourFutureNexus.vip | Your Future Nexus LLC ("Nexus") |
| Your Future Care web pages | Your Future Care ("Care") |
YFC, Nexus, and Care are affiliates owned by Your Future LLC. In these Terms, "we," "us," and "our" mean the operator of the Site you are using. "Sites" means the websites, job board, talent network, forms, and related online services listed above.
1.2 Related documents
These Terms incorporate our US Privacy Policy (YFC-PRIV-1.0), Consumer Health Data Privacy Policy (YFC-PRIV-2.0), and Cookie and Tracking Notice (YFC-PRIV-4.0). Paid services (for example, an employer recruiting agreement, a Nexus coaching agreement, or a Care client agreement) are governed by their own signed agreement. If a signed agreement conflicts with these Terms, the signed agreement controls for that service.
2. Eligibility
- You must be at least 16 years old to use the Sites.
- If you are 16 or 17, you may apply only for roles that minors may lawfully perform, and modeling or youth representation requires written consent from your parent or legal guardian.
- The Sites are not directed to children under 13, and we delete information we learn was submitted by a child under 13.
- If you use the Sites for an organization, you confirm that you have authority to bind that organization to these Terms, and "you" includes that organization.
- The Sites are offered for use in the United States.
3. Accounts
3.1 Job seeker accounts
If you create an account, you agree to give accurate information, keep your login credentials confidential, and tell us promptly at privacy@yourfuturecareer.vip if you believe your account was compromised. You are responsible for activity under your account.
3.2 Employer accounts for the talent network
Employer accounts are available to employers that YFC approves. YFC may verify the employer's identity, business, and hiring purpose before granting access, and may require a signed recruiting agreement. Each employer user must have an individual login. Employers keep their credentials confidential and are responsible for every user they authorize.
3.3 Suspension and closure
We may suspend or close an account, remove content, or limit access when we reasonably believe a user has broken these Terms, created risk for other users, or acted unlawfully. You may close your account at any time by contacting us. Closing an account does not delete information we must keep by law; see the Privacy Policy for retention and deletion rights.
4. Acceptable use
You agree to use the Sites only for lawful purposes and in line with these Terms. You agree to refrain from:
- submitting false, misleading, or someone else's information, or impersonating any person or organization;
- posting a job that is fake, misleading, unlawful, a pyramid or multilevel marketing scheme, commission-only without clear disclosure, or that asks applicants to pay a fee;
- posting content that is discriminatory, harassing, threatening, defamatory, obscene, or infringing;
- collecting personal information of other users, including by scraping, crawling, data mining, or automated extraction, except through features we provide for that purpose;
- using bots, scripts, or automated tools to access, search, or submit content to the Sites without our written permission;
- attempting to probe, scan, or test the vulnerability of the Sites, bypass security or access controls, or access data or accounts you are not authorized to access;
- uploading viruses, malware, or harmful code;
- interfering with or overloading the Sites;
- sending spam or unsolicited commercial messages through the Sites; and
- using the Sites to train artificial intelligence or machine learning models, or to build a competing database or service.
5. Resume and content you submit
5.1 Your ownership
You keep ownership of the resume, profile, photos, portfolio, and other content you submit ("Your Content").
5.2 Limited license for recruiting
You grant the operator a non-exclusive, royalty-free, revocable license to store, copy, format, and display Your Content solely to provide recruiting, placement, representation, coaching, or care services you request, including:
- reviewing Your Content and matching you to roles;
- creating a blind profile that removes your name and contact details, if you opt into the talent network;
- presenting your identified profile and resume to a specific employer after you approve that employer; and
- reformatting your resume into our standard presentation format, which you can review on request.
We use Your Content only for these purposes. We do not sell Your Content, license it to third parties as a product, or use it to train large language models. You may revoke this license at any time by asking us to delete Your Content, subject to records we must keep by law. Revocation does not recall submissions you already approved.
5.3 Your promises
You confirm that Your Content is accurate and truthful, that you have the right to submit it, and that it contains no information about other people (such as references) that you lack permission to share. Please do not include your Social Security number, date of birth, health information, photos of identity documents, or pay history in Your Content.
5.4 Feedback
If you send us suggestions about the Sites, we may use them without obligation to you.
6. Employer access and talent network restrictions
This Section applies to every employer, employer user, and subscriber that receives candidate information through the Sites, talent network emails, or YFC.
- Hiring evaluation only. Employers use talent network profiles and candidate information solely to evaluate candidates for genuine open positions at the employer's own organization.
- Blind profiles. Talent network profiles are anonymized. Employers keep them anonymized and refrain from attempting to identify any candidate from a blind profile, including by searching public sources or combining details.
- Contact through YFC. Employers request introductions to any candidate through YFC. Employers contact candidates introduced or displayed by YFC only through YFC until YFC confirms the introduction in writing.
- Non-circumvention. Hiring, engaging, or contracting a candidate introduced or displayed by YFC (directly, through an affiliate, or through another agency) is subject to the fee and non-circumvention terms in the employer's signed recruiting agreement with YFC. An employer that accesses the talent network without a signed agreement agrees that YFC's then-current standard placement fee applies to any such hire made within 12 months after the introduction or display.
- No scraping or export. Employers refrain from scraping, downloading in bulk, copying into another database, or reselling any candidate information.
- Confidentiality and security. Employers keep candidate information confidential, protect it with reasonable security, share it only with personnel involved in the hiring decision, and delete it when the hiring purpose ends or when YFC or the candidate asks.
- Lawful use. Employers use candidate information in compliance with anti-discrimination laws (including Title VII, the ADA, the ADEA, and Wis. Stat. 111.31 to 111.395), the Fair Credit Reporting Act, state fair-chance laws, salary history bans, and privacy laws. Employers refrain from asking YFC for, or using, salary history, and conduct background checks only after a conditional offer and with the candidate's written authorization.
- Breach notice. Employers notify YFC within 72 hours after learning of any unauthorized access to or disclosure of candidate information.
- Audit and removal. YFC may monitor employer use, request confirmation of compliance, and remove access at any time.
7. Job postings and pay transparency
Employers and YFC staff who post jobs on the Sites agree that every posting:
- describes a real, currently open position;
- states the employer's good-faith pay range (hourly rate or salary) and a general description of benefits and other compensation, to comply with pay transparency laws in Colorado, Washington, New York, California, Illinois, Minnesota, Maryland, New Jersey, Massachusetts, Vermont, Hawaii, Maine, Virginia, Connecticut, Delaware (from September 26, 2027), the District of Columbia, and local ordinances, and in all other states as YFC policy;
- states whether the role is remote, hybrid, or on-site, and the work location;
- uses no language that expresses a preference based on a protected class, including age proxies such as "recent graduate" or "digital native";
- asks no salary history questions;
- asks no criminal history questions before a conditional offer; and
- includes the EEO statement in Section 15.
YFC may edit or remove any posting that falls short of these standards. If you see a posting you believe is fake or unlawful, report it to info@yourfuturecareer.vip.
8. No guarantee of employment or results
YFC is an employer-paid employment agency registered with the Wisconsin Department of Workforce Development under Wis. Stat. ch. 105. Job seekers pay no fee to YFC for placement. Using the Sites does not guarantee an interview, a job offer, employment, a particular salary, or any result. Employers make their own hiring decisions. Job availability, pay, and terms are set by employers and may change. Nexus coaching and Care services are provided under their own agreements and carry no guarantee of employment, health outcome, or specific result.
9. Artificial intelligence tools
We use AI tools to help draft documents, summarize resumes, organize notes, and suggest possible matches. A human recruiter reviews every AI output and makes every candidate submission and every hiring-related decision. AI output may contain errors, and you should review any document we prepare with AI assistance before relying on it. You may request human-only review of your materials, ask how a match was reached, or request a reasonable accommodation by contacting privacy@yourfuturecareer.vip. More detail is in Section 10 of the Privacy Policy. If a Site offers an AI chat or assistant, it identifies itself as AI.
10. Intellectual property
The Sites and their content (text, design, graphics, logos, the YFC, Nexus, and Care names and marks, software, and compilations), excluding Your Content and job postings submitted by employers, are owned by us or our licensors and protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to view and use the Sites for their intended personal or internal business purposes under these Terms. Any other use requires our written permission.
11. Copyright complaints (DMCA)
We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. 512). Our designated agent is:
DMCA Agent, Your Future Career LLC
210 N Main St, Oshkosh, WI 54901
privacy@yourfuturecareer.vip
A notice must include: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the infringing material and its location on the Sites; (4) your contact information; (5) a statement that you have a good-faith belief that the use is unauthorized; and (6) a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act for the copyright owner. If your content was removed, you may send a counter-notice meeting 17 U.S.C. 512(g)(3). We terminate the accounts of repeat infringers in appropriate circumstances.
12. Third-party services and links
The Sites may include links to or embedded tools from third parties, such as scheduling tools, video meeting tools, professional networking sites, and e-signature services. Those services operate under their own terms and privacy policies, and we are not responsible for them.
13. Disclaimers
To the extent permitted by law, the Sites and their content are provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the Sites are uninterrupted, error-free, or free of harmful components. We do not verify every job posting, employer, or candidate statement, though we take reasonable steps to screen postings and employers. Content on the Sites is general information and is not legal, financial, tax, medical, or immigration advice.
Some states do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you. Nothing in these Terms limits any warranty that cannot be excluded under applicable law.
14. Limitation of liability
To the extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost business opportunities, arising from your use of the free features of the Sites.
- Our total liability for any claim arising from your use of the free features of the Sites is limited to the greater of 100 US dollars or the amount you paid us for the Sites in the 12 months before the claim.
- Liability under a paid service agreement is governed by that agreement.
Carve-outs. These limits do not apply to liability for death or personal injury caused by our negligence, for fraud or intentional misconduct, for our gross negligence, for violations of privacy or data security laws that cannot be limited by contract, or for any other liability that cannot be limited under applicable law. Some states, including New Jersey, do not allow certain limitations of liability, so some of these limits may not apply to you. If you live in New Jersey, the limitations in this Section apply only to the extent allowed by the New Jersey Truth-in-Consumer Contract, Warranty and Notice Act (N.J.S.A. 56:12-14 to 56:12-18).
15. Equal employment opportunity
YFC and its affiliates are equal opportunity employers and employment agencies. We recruit, refer, and place applicants without regard to race, color, religion, creed, sex (including pregnancy, sexual orientation, and gender identity), national origin, ancestry, age (40 and over, and as protected by state law), disability, genetic information, marital status, military or veteran status, arrest or conviction record (as provided in Wis. Stat. 111.321 and 111.335), use or nonuse of lawful products off the employer's premises during nonworking hours, declining to attend a meeting or participate in communication about religious or political matters, or any other characteristic protected by federal, state, or local law. We refuse job orders that request discrimination. We consider qualified applicants with arrest and conviction records in accordance with Wis. Stat. 111.335 and applicable fair-chance laws.
16. Accessibility and accommodations
We aim for the Sites to conform to the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA, and we test and improve them on an ongoing basis. If you have difficulty using any part of the Sites, or need a reasonable accommodation to apply, interview, or complete any step in the hiring process, contact us and we will help you by another method, such as applying by phone or email:
- Email: info@yourfuturecareer.vip (subject: "Accommodation Request")
- Phone: (920) 383-1992
- Mail: 210 N Main St, Oshkosh, WI 54901
Accommodation requests are kept confidential and used only to provide the accommodation.
17. Indemnity
If you are using the Sites for a business (including as an employer), you agree to defend, indemnify, and hold harmless the Your Future companies and their members, managers, employees, and agents from third-party claims, losses, and reasonable attorneys' fees arising from your breach of these Terms, your job postings, or your misuse of candidate information. This Section does not apply to individuals using the Sites for personal, family, or household purposes, or to job seekers.
18. Governing law
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-laws rules. If you are a consumer, this choice of law does not deprive you of the protection of mandatory consumer protection or privacy laws of the state where you live, which continue to apply to you.
19. Dispute resolution
- Talk to us first. Before filing a claim, please contact the Privacy Officer at privacy@yourfuturecareer.vip or 210 N Main St, Oshkosh, WI 54901 with a description of the issue and the outcome you want. We will try to resolve it within 30 days. Either party may then proceed under step 2.
- Small claims or court. Either party may bring an individual claim in small claims court in Winnebago County, Wisconsin, or in the small claims court of the county where you live, if the claim qualifies. Otherwise, claims are brought in the state or federal courts located in Winnebago County, Wisconsin. If you are a consumer, you may instead bring a claim in the courts of the county where you live, and nothing here limits a venue right that consumer law gives you.
- No mandatory arbitration. These Terms do not require arbitration. You and we may agree in writing, after a dispute arises, to resolve it by mediation or arbitration.
- Agencies. Nothing in these Terms prevents you from filing a complaint with a government agency, including the Equal Employment Opportunity Commission, the Wisconsin Department of Workforce Development, a state attorney general, or a privacy regulator.
- Time to bring claims. Any claim must be brought within the period set by applicable law.
20. Changes to these Terms
We may update these Terms. We post the updated version on the Sites with a new "Last updated" date. If a change is material, we give notice by email (if we have your email) or a prominent notice on the Sites at least 30 days before it takes effect. Changes apply going forward and do not apply to a dispute that arose before the change. If you continue to use the Sites after a change takes effect, the updated Terms apply.
21. General
- Entire agreement. These Terms and the documents they incorporate form the entire agreement about the Sites, except for any signed service agreement.
- Severability. If a court finds any provision unenforceable, that provision is limited to the minimum extent needed, and the rest remains in effect.
- No waiver. Our failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms without our consent. We may assign them to an affiliate or a successor.
- Electronic communications. You agree that we may provide notices electronically. Electronic signatures on our forms are valid under the federal E-SIGN Act (15 U.S.C. 7001) and Wis. Stat. ch. 137, and you may request a paper copy of any notice.
- Survival. Sections 5, 6, 10, 13, 14, 17, 18, 19, and 21 survive termination.
